Some properties may be shown by appointment. Do not enter any property without authorization. Unauthorized entry constitutes trespassing and will be prosecuted. As Found Auctions is not liable for injury during any viewing.
Your bid is the price you offer the seller. The 4% buyer premium is separate, collected at closing.
Once submitted, your bid cannot be withdrawn. You owe nothing unless selected as the winning bidder.
Any bid placed within the last 5 minutes automatically extends the auction by 5 minutes, giving all bidders a fair chance to respond.

As Found Auctions is a registered assumed business name operating under Oregon Licensed Real Estate Brokerage. These Terms govern participation in any auction on this platform. By submitting a bid, you agree to be bound by these Terms.
Every property is sold strictly as-is, where-is, with no representations or warranties of any kind — express, implied, or statutory.
Authorized access only. Some properties listed on As Found Auctions may be made available for viewing by scheduled appointment. Access details, if any, will be noted on the individual listing. Where no access is indicated, the property is not available for viewing or inspection prior to bidding.
Some properties cannot be viewed or inspected due to hazardous, dangerous, or otherwise unsafe conditions. As Found Auctions and the seller make no representations regarding the safety of any property and assume no duty to warn beyond what is stated on the listing.
Unauthorized entry is trespassing. Any person who enters, attempts to enter, or remains on a listed property without express written authorization from As Found Auctions or the seller is trespassing. Violators will be reported to law enforcement and prosecuted under applicable Oregon trespass statutes. Civil liability may also be pursued.
Hold Harmless. By participating in any auction on this platform, you agree that As Found Auctions, its principals, agents, and licensees shall be held harmless from and against any and all claims, losses, damages, injuries, or liabilities of any kind arising from or related to any entry onto, viewing of, inspection of, or proximity to any listed property, whether authorized or unauthorized, including but not limited to personal injury, property damage, or death.
All bidders must register and verify their email address before placing any bid. A verification code will be sent to your email; you must enter this code to activate your bidder account. As Found Auctions reserves the right to disqualify any registrant at any time.
To ensure a fair bidding process, any bid placed within the final 5 minutes of an auction's scheduled closing time will automatically extend the auction closing time by 5 minutes from the time of that bid. This extension may repeat each time a bid is placed within the extended window. There is no limit to the number of extensions that may occur. All registered bidders are subject to this rule, and by bidding you acknowledge and accept it.
The seller selects a winning bidder at their sole and absolute discretion and may reject all bids prior to execution of a written purchase agreement.
A 4% buyer premium is charged to the winning bidder at closing, applied to the accepted sale price. Non-negotiable. Applies to all sales. Example: A $250,000 winning bid results in a $10,000 buyer premium — total $260,000 before other closing costs.
If selected, you must deliver a $3,000 earnest money deposit within 3 calendar days of notification to the escrow agent designated by As Found Auctions for that transaction. This deposit is credited in full toward your purchase price at closing. As Found Auctions does not accept or hold deposit funds.
All bids submitted through As Found Auctions require an electronic signature in the form of the bidder's typed full legal name. By typing their name in the designated signature field and submitting a bid, the bidder agrees that such signature is binding and enforceable under the Oregon Uniform Electronic Transactions Act (ORS Chapter 84) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN). The typed name, together with the bid submission record and all four acknowledged checkboxes, constitutes the bidder's legally binding agreement to these Terms & Conditions, the bid amount, the 4% buyer premium, all closing cost obligations, and all other obligations arising from selection as the winning bidder.
The four acknowledgments required at time of bidding confirm that the bidder: (1) has completed all due diligence and accepts the as-is condition; (2) understands the deposit requirement and non-refundable terms; (3) accepts the 4% buyer premium and anti-sniping rule; and (4) has reviewed the sample Purchase and Sale Agreement and accepts responsibility for customary closing costs and escrow fees.
A binding sale occurs only upon execution of a written purchase and sale agreement signed by both parties. A sample purchase and sale agreement is made available on each listing for review by all prospective bidders prior to placing a bid. By bidding, buyer acknowledges having had the opportunity to review the sample agreement. Court confirmation required where applicable.
As Found Auctions works with preferred title and escrow providers, including AmeriTitle (320 Church St NE, Salem, OR 97301). The title and escrow company for each transaction will be designated on the individual listing. Buyer may select their own title company subject to seller approval. A preliminary title report is made available on each listing prior to the auction closing date.
By placing a bid, buyer acknowledges having had the opportunity to review the preliminary title report and accepts title as disclosed in that report. Title objections are limited solely to defects or encumbrances that were not disclosed in the preliminary title report and that arise or are discovered after the auction closes and that prevent the seller from conveying marketable title. No other title objections will be recognized. Title objections may not be used as a mechanism to exit a transaction for any other reason, including but not limited to buyer remorse, financing failure, inspection findings, or changes in market conditions.
All-cash or hard-money financing is the default expectation for all purchases. Financing may be considered on a case-by-case basis at the seller's sole discretion and must be disclosed at the time of bidding. No financing contingency is available. Buyers intending to use financing must confirm their lender's willingness and ability to fund on an as-is property with no contingencies before placing a bid. Any approved financing is subject to written agreement by the seller prior to execution of a purchase agreement.
Buyer is responsible for all customary buyer-side closing costs, which are separate from and in addition to the accepted bid price and the 4% buyer premium. These costs include but are not limited to:
An estimated closing cost breakdown is displayed in the bid submission form for informational purposes only. Actual closing costs may vary. Buyer is encouraged to obtain a closing cost estimate from the designated escrow agent prior to bidding. By submitting a bid, buyer acknowledges having reviewed the sample Purchase and Sale Agreement and accepts responsibility for all closing costs as described above.

These Terms are governed by the laws of the State of Oregon.
As Found Auctions may update these Terms at any time. Terms in effect at the time a bid is submitted govern that bid.
